Legal / Statutory Compliance

MOUNTING UP – HR SERVICES provides a plethora of services on the legal and compliance activities related to employee and organization.

Advising & Obtaining Registrations, Licenses, Plans and Code Numbers

We advise and also assist in obtaining registrations and other statutory licenses under the relevant establishment acts for shops and commercial businesses. We also ensure compliance under relevant labor laws / Acts and factories Act. We advise on compliance with plans as per Factories Act and obtain code numbers under ESI and PF Act.

Filing of Returns under Various Acts

We closely monitor and manage the timely filing of returns across various statutory schemes to ensure both the company and its employees remain fully compliant. This includes monthly filings such as Provident Fund and Professional Tax, half-yearly filings under ESI and Contract Labour Acts, and annual filings related to Provident Fund, Contract Labour, Payment of Wages Act, Minimum Wages Act, and the Maternity Benefit Act.

Monitoring of Contract Labor

We ensure compliance by conducting audit every 2 months, provide a proper employment letter following the compliance and safeguarding the company from any legal implications, ESI and PF benefits duly complied. Compliance under minimum wages Rules, License renewal under contract labor Act, monitor overtime, maintenance of leave record and Bonus.

Legal Management

We make representations on behalf of the company in all legal matters before the Labor officers and other conciliation bodies and work towards the best solution for the company.

Assisting and Advising on inspections and audits

Assisting and providing advice and strategies to ensure compliance during inspections and audits under various Acts like – Shop & Commercial Establishment Act, Factories Act, ESI Act and PF Act.

Disciplinary Action Procedures

We offer comprehensive support in managing disciplinary actions to ensure that any non-compliance with company policies is handled in accordance with legal requirements, protecting the organization from potential litigation. Our services include, but are not limited to, maintaining records of warning letters, drafting notices for warnings, suspensions, and terminations, and ensuring full compliance with internal (domestic) enquiry procedures.
